1. Scope and Who We Are
This Privacy Policy describes the collection, use, sharing, and other processing of information, both online and offline, by Constructed Learning, LLC (“Constructed Learning,” “CL,” “Company,” “we,” “us,” or “our”).
This Policy applies to:
constructed-learning.com — the Constructed Learning website and the products and content hosted there; and
thevisualnonglossary.com — The Visual Non-Glossary (“The VNG”) and the content hosted there.
The two websites above are together the “Sites.”
“Services” means the Sites and each website, application, tool, platform, database, video, course, module, download, and other product or content that Constructed Learning makes available through the Sites, whether available as of the Effective Date or made available afterward. “Content” means all material comprising or made available through the Services, including pictures, photos, and drawings in digital format; software, interfaces, and data organization; video; and written and multimedia instructional and professional development materials.
By accessing the Sites or otherwise using or interacting with the Services — for example, by viewing, downloading, or both — You (“You,” “Your”) agree that Your access and use are governed by this Policy.
This Policy works alongside our Terms of Use, which govern Your use of the Services. Where an institution has executed a written agreement or data protection agreement with us, Section 7 of this Policy describes how that agreement interacts with this Policy.
Section 14 describes how we change this Policy.
2. Who the Sites Are For
This Policy is intended for a general audience age 18 years or older. The Services are directed to adults — teachers, school and district administrators, parents, and other adult users. We do not market or sell our products or services to students.
Our Terms of Use require account holders to be 18 years of age or older. Registration requires a work email address. We do not ask for Your date of birth or otherwise collect age information. We do not knowingly collect personal information from anyone under 18 through the Services. In accordance with the Children’s Online Privacy Protection Act, we do not knowingly collect personal information through the Services from children younger than 13 years of age.
If we learn that we have collected personal information from a person under 18, we will delete it and close any associated account. If You believe a minor has provided us with information, contact us at info@constructed-learning.com.
3. Information We Collect
3.1 Information You Provide to Us
We collect information about You directly through the Services. Some of the information we collect is considered “personal information” or “personal data” under applicable laws, such as Your name, phone number, and email address.
When You create an account, begin a free trial, contact us, subscribe to our newsletter, register for an event, post a comment, or make a purchase, information Constructed Learning may collect includes, but is not limited to:
First and last name
Email address, phone number, and other contact information
The name and information of the school and/or school system where You work
Your role and the grade level(s) You teach
Account credentials (username and password)
Event registration details
The content of comments You post, and the content of messages You send us for support or service
Information provided by You as You interact with Constructed Learning for support or service associated with the Services
Billing and transaction information
3.2 Google and Microsoft Sign-In
Users access Constructed Learning by signing in with either a Google account or a Microsoft account. We do not offer separate username-and-password authentication.
When You sign in with Google or Microsoft, we receive limited account information authorized by You and the applicable identity provider, which may include Your name, email address, profile image, and a unique account identifier.
We use this information only to authenticate You, identify and maintain Your Constructed Learning account, associate You with the appropriate school, district, license, or subscription where applicable, and provide access to the Services.
We do not use Google Sign-In to access Your Gmail messages, Google Drive files, Google Calendar, contacts, or other Google account content, and we do not use Microsoft Sign-In to access Your Outlook email, OneDrive files, calendar, contacts, or other Microsoft account content, unless a Service expressly requests such access and You separately authorize it.
Information received through Google or Microsoft Sign-In is handled in accordance with the use, security, retention, deletion, and sharing practices described in this Privacy Policy. We do not sell this information or use it for advertising.
Information obtained through Google or Microsoft authentication APIs is used only to provide or improve user-facing functionality of the Services and is not used to develop, improve, or train generalized artificial intelligence or machine-learning models.
3.3 Information Collected Automatically
In accordance with applicable law (including with Your consent, if required), Constructed Learning may automatically collect and/or store certain information when You visit or interact with the Services (“Usage Information”). This Usage Information may be stored and/or accessed from Your computer, tablet, mobile phone, or other device whenever You visit or interact with the Services. Usage Information may include, but is not limited to:
IP address and approximate location derived from it
Browser type, device type, and operating system
Pages viewed, links clicked, downloads requested, and time spent
Referring website or source
Cookie and similar identifiers
How You use and interact with the Services, including features You use and Content You access or download
Constructed Learning will also treat other information, including IP addresses and cookie identifiers, as “personal information” where required by applicable law.
3.4 Information We Receive from Schools and Districts
Where a school, district, or other educational institution provides access for its employees, we may receive staff information from that institution — for example, educator names, work email addresses, roles, and campus assignments — in order to create and support those accounts.
We do not request or receive student rosters or student records from schools or districts.
3.5 Payment Information
Payments are processed by Stripe, Inc. We do not collect or store Your full payment card number. Stripe provides us with transaction records — such as amount, date, and the last four digits of the card — for order fulfillment, accounting, and support. Stripe processes Your payment information under its own privacy policy.
Free trials do not require a payment method. Where we offer a free trial that does not require a payment method, we collect no payment or billing information from You unless and until You choose to subscribe.
3.6 A Note on “Sensitive” Information
We do not seek to collect information that state privacy laws classify as sensitive data, such as precise geolocation, biometric identifiers, health information, or the personal data of a child under 13. Please do not send us such information.
3.7 Artificial Intelligence
The Services do not process Your input, Your account information, or Your Usage Information through any artificial intelligence system. We do not send Your information to any AI vendor, and we do not use Your information to train any AI model.
Generative artificial intelligence tools are used in a limited, assistive capacity in the production of some Content — for example, to modify an individual element within a visual that Constructed Learning designed. All Content is reviewed by Constructed Learning before it is published. This use involves our own materials and does not involve Your personal information.
4. Cookies and Analytics
We use cookies and similar technologies to keep You signed in, remember Your preferences, keep the Services secure, and understand how the Services are used.
We use Google Analytics 4 (GA4) to measure traffic and usage. GA4 places cookies and collects Usage Information described in Section 3.3. Google processes this information under its own terms and privacy policy. You can opt out of Google Analytics using Google’s browser opt-out add-on, or by blocking cookies in Your browser.
You can control cookies through Your browser settings. Blocking cookies that are strictly necessary may prevent You from signing in or using parts of the Services.
Embedded video. Our professional learning videos are hosted on YouTube (Google LLC) and embedded in the Services. We use YouTube’s privacy-enhanced embed, which is designed to limit cookie storage until You play a video. When You play an embedded video, YouTube may set cookies and receive information about Your device and viewing under Google’s own privacy policy, over which we have no control.
We do not display advertising on the Services, we do not use cookies to advertise to You elsewhere, and we do not sell or share Your information with advertising networks. We do not control what Google collects through the embedded video player or through Google Analytics, and Google may use that information under its own policies.
5. How We Use Your Information
We may use non-personal information for any purpose allowable by law. We use information collected from or about You, including personal information, as disclosed in this Policy, including to:
Allow You to use and interact with the Services, including processing Your transactions, account registration, free trial access, and Your downloading of Content;
Respond to Your requests for information, troubleshoot problems, and provide You with customer service;
Verify Your identity and protect account security;
Administer free trials, including applying any download or usage limit that applies to a trial and preventing repeated or duplicate trial sign-ups;
Maintain the Services, manage access to them, and manage the licenses granted to You under our Terms of Use;
Send You administrative and transactional messages about Your account, purchases, licenses, subscription renewals, or events;
Send newsletters and product updates, where You have subscribed. You can unsubscribe at any time;
Publish comments You choose to post;
Contact You regarding Your use of the Services and any license You hold;
Understand how the Services are used, and maintain, improve, and develop our Services and Content; and
Comply with the law and protect the safety, rights, property, or security of Constructed Learning, the Services, the Content, users of the Services, and the general public, including investigating and preventing fraud, illegal activities, and activities that violate our Terms of Use.
We may use de-identified or aggregated information — information that does not identify You and cannot reasonably be used to identify You — for any lawful purpose, including improving our products.
6. How We Share Your Information
We do not sell Your personal information. We do not share it for cross-context behavioral advertising or targeted advertising.
We build and operate our own customer management, contact form, and email systems in-house. Information You submit through our forms and our newsletter subscriber lists are held in systems we control and are not passed to an outside marketing or CRM provider.
We share information in the following limited circumstances:

Schools and districts. Where an institution has purchased or provisioned access, we may share account and usage information with that institution’s designated administrators, as permitted by our agreement with them. Our Terms of Use describe institutional subscriptions and the role of a designated administrator.
Legal and safety. We may disclose information where required by law, subpoena, or court order, or where we believe in good faith that disclosure is necessary to protect our rights, Your safety, or the safety of others, or to investigate fraud.
Business transfers. If Constructed Learning is involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction. We will require the recipient to honor the commitments in this Policy or provide notice of any material change.
7. Student Data and School Relationships
We do not collect student data. Specifically:
We do not create or permit student accounts.
We do not request, require, or receive student rosters, student records, grades, assessment results, or other student information from schools or districts.
We do not market or sell our products to students.
Student use of the Content takes place in the classroom, offline, outside of our systems. We receive no information about it.
Information we receive from institutions is staff information. Where a school or district provisions access for its employees, the information we receive is limited to educator and administrator details as described in Section 3.4. We use it only to create and support those accounts and to fulfill our agreement with that institution.
Incidental student information. Please do not send us student names or other student information through contact forms, comments, or support messages. Our Terms of Use prohibit posting student information in comments. If we receive student information we did not request, we delete it once identified and do not use it for any purpose.
Data protection agreements. We enter into data protection agreements with schools, districts, regional service centers, and other local education agencies on request. Where we have signed such an agreement, its terms govern our handling of any information covered by it, and control over this Policy to the extent of any conflict. Deletion. A school or district may request that we delete information we hold on its behalf by contacting info@constructed-learning.com. We will honor the request within a reasonable period, except where we are required to retain records by law or by the terms of an active agreement. Section 10 describes how long we keep information generally, and Section 11 describes the rights available to individual users.
8. Comments and Public Content
Comments You post on the Services are visible to other users and may be visible to the public. Do not include personal information, student information, or anything else You do not want publicly available.
We may moderate, edit, refuse to post, or remove comments at our discretion, as described in our Terms of Use.
9. Information Security
Commercially reasonable steps designed to secure Your personal information will be utilized; however, Constructed Learning cannot ensure and does not guarantee the security of any information we collect and cannot guarantee protection of all information against hack, interception, misappropriation, misuse, or alteration, or that Your information may not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others.
You use the Services and provide us Your information at Your own risk.
10. How Long We Keep Your Information
We keep personal information only as long as we need it for the purposes described in this Policy, or as long as the law requires. When a retention period ends, we delete the information or de-identify it so that it can no longer reasonably be linked to You.

We may keep information longer than the periods above where we are required to do so by law, by a court order, by the terms of an active agreement with an institution, or where it is necessary to resolve a dispute, enforce our Terms of Use, or investigate fraud or a security incident.
Information may persist in routine backups for a limited period after deletion from our active systems. Backup copies are not used for any operational purpose and are overwritten on our normal backup cycle.
11. Your Choices and Your Rights
We offer the following to all users of the Services, regardless of where You live. Some users may also have rights under the privacy law of their state, and nothing here limits those rights.
Access. You may request a copy of the personal information we hold about You.
Correction. You may correct most of Your information directly in Your account. For anything You cannot change Yourself, contact us and we will correct it.
Deletion. You may request that we delete Your personal information and close Your account. We will honor the request except where we are required to keep information by law, by an active agreement with an institution, or for the limited purposes described in Section 10.
A copy of Your information. You may request Your information in a portable, machine-readable format.
Marketing messages. You may unsubscribe from newsletters and product updates at any time using the link in any such message, or by contacting us. We will still send You administrative and transactional messages about Your account, purchases, and subscription while Your account is open.
Cookies and analytics. Section 4 describes how to control cookies and how to opt out of Google Analytics.
How to make a request. Email info@constructed-learning.com. We will ask You to verify Your identity, usually by confirming that You control the email address on the account, before we act on a request about personal information. We aim to respond within 45 days, and will tell You if we need more time.
Authorized agents. You may use an authorized agent to make a request on Your behalf. We may ask for proof of the agent’s authority and may ask You to verify Your identity directly.
If we decline. If we decline a request, we will tell You why. You may ask us to reconsider by replying to our response, and a different person at Constructed Learning will review the decision.
No penalty. We will not deny You service, charge You a different price, or provide You a lower quality of service because You exercised any of these rights.
Institutional accounts. Where a school or district provisioned Your access, some information about Your account is held on that institution’s behalf. We may direct Your request to that institution or ask it to instruct us, and Section 7 describes how a signed agreement with an institution affects our handling of that information.
12. Consent to Transfer
Please be aware that Your connection to the Services will be through and to servers located in the United States. By using the Services or providing Constructed Learning with any information, You consent to transfer of Your information to servers in the United States, and to the processing, usage, sharing, and storage of Your information in the United States, for which the privacy laws may differ from those in the state or country where You reside and/or are a citizen. As a result, this information may be subject to access requests from governments, courts, or law enforcement in the United States and other countries according to the laws in those jurisdictions.
13. Third-Party Links and Embedded Content
The Services may link to, or embed content from, third-party services — including video embedded from YouTube and our payment processor, Stripe. These third parties may collect information about You under their own privacy policies. We do not control and are not responsible for their practices. We encourage You to review the privacy policy of any third-party service You use.
14. Changes to This Policy
We may update this Policy from time to time. When we do, we will change the Effective Date at the top.
If we make a material change to how we use personal information we have already collected, we will provide notice — by email to registered users, by a notice on the Services, or both — before the change takes effect, to the extent applicable law requires. Your continued use of the Services after an update takes effect constitutes acceptance of the updated Policy to the fullest extent permitted by law.
